          Returns and Rights of Withdrawal

          In the following we would like to introduce our revocation conditions. You have the following right of revocation when purchasing at DocCheck Shop:

          Revocation Policy for Consumers

          Please note that the offer of our shop is primarily aimed at Professionals within the meaning of § 14 Section 2 of the German Civil Code (BGB); further information on this can be found in § 1 Section 2 of our General Terms and Conditions.

          A "Consumer" (within the meaning of § 13 German Civil Code) is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.

          A "Professional", also "Entrepreneur" or "Business Customer", (§ 14 German Civil Code) is any natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in exercise of his or its independent professional or commercial activity; this also expressly applies to freelancers such as doctors or pharmacists.

          In the following we would like to inform you about our revocation conditions that apply to you as a Consumer.


          Damaged or defective goods?

          Your item has a defect or is damaged and you would like to know what warranty and guarantee claims you are entitled to? Please refer to the information in our General Terms and Conditions.

           

          Revocation Rights for Consumers

          The following revocation rights apply if you are a Consumer. If you are placing your order from Switzerland, please note our information under 8.

          Please also note the information under 4 ("Grounds for Exclusion or Extinction").

          1. Your Revocation Rights

          You have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen (14) days from the day

          • on which you or a third party named by you, who is not the carrier, have taken possession of the goods, if you have ordered one or more goods as part of a single order and these are delivered uniformly;

          • on which you or a third party named by you, who is not the carrier, have taken possession of the last goods, if you have ordered several goods as part of a single order and these are delivered separately.

          2. Declaration of Revocation

          To be able to exercise your Right of Revocation, you must inform us (DocCheck Shop GmbH, Vogelsanger Str. 66, 50823 Cologne, Germany, e-mail address: info@doccheckshop.com, Tel.: +49 (0)221 92053-777) of your decision to revoke this contract by means of a clear declaration (e.g. a letter sent by post or e-mail). You can use the sample revocation form attached under 6, but this is not mandatory.

          To meet the revocation deadline, it is sufficient for you to send your notification of exercising your right of revocation before the revocation period expires.

          After revocation, the goods must be returned to us within fourteen (14) days at the latest.

          3. Implications of the Revocation

          If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. However, please note our instructions under 4 in the event of improper use of the goods by you.

          We may refuse to refund you for goods that can be sent by package until we have received these goods back or until you have provided proof that you have sent these goods back, whichever is the earlier.

          We will arrange for goods that cannot be sent by package to be collected from you by a service provider.

          You must return or hand over the goods that can be sent by package to us immediately and in any case within fourteen (14) days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you dispatch the goods that can be sent by package before the period of fourteen days has expired.

          You bear the direct costs of returning goods that can be sent by package.

          We bear the costs of returning goods that cannot be sent by package.

          4. Grounds for Exclusion or Extinction

          The right of revocation does not exist or expires prematurely for contracts

          • for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, e.g. engravings, individualised prints or similar;

          • for the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded;

          • for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature;

          • for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery;

          • for download products and the submission of a corresponding waiver, see § 2.2 of our General Terms and Conditions.


          If the ordered goods are not suitable for return for reasons of health protection or hygiene, if their seal has been removed or damaged in any other way after delivery, an initially existing right of revocation expires as soon as the seal is removed or damaged in any other way.

          Medicines, medical products, goods requiring refrigeration, hygiene articles, test strips or cosmetics may also be excluded from revocation insofar as these are definitively no longer marketable for reasons of health protection or hygiene because it is impossible or excessively difficult for us as a company to make them marketable again due to their nature.

          5. Compensation for Improper Use, Improper Return Shipment or Damage to the Goods

          If you receive your goods from us, you are of course entitled to inspect and test the goods received from us (please note the exceptions to the above-mentioned grounds for exclusion of revocation) and to exercise your right of revocation.

          Please note, however, that we reserve the right to claim compensation if you return goods to us that have arrived in working order and have been improperly inspected or damaged by you and have suffered a loss in value as a result. This is the case according to § 357a Section 1 No. 1 of the German Civil Code (BGB) if the loss in value is due to handling of the goods that was not necessary to check the condition, properties and functionality of the goods. We will also claim compensation if you have obviously damaged the goods.

          The goods you return may also be damaged during return transport. Therefore, please return any goods you wish to return to us in suitable parcels that are adequately secured with filling material. We would also kindly ask you to return the goods in their original packaging.

          6. Revocation-Form Sample

          If you wish to cancel the contract, please fill in our revocation form.

          7. Returns and Refunds

          Please use the return label included in your delivery to return your goods. For the return of your parcel-capable goods, we ask you to choose the appropriate parcels with sufficient protection through filling material. We would also kindly ask you to return the goods in their original packaging.

          If the goods cannot be sent by parcel post, please contact us so that we can arrange a collection. Please note that you may incur costs for such a return in individual cases.

          For the refund of the purchase price paid, we will use the same means of payment that you used for the original transaction. We may refuse to refund you for goods that can be sent by parcel post until we have received these goods back or until you have provided proof that you have sent these goods back, whichever is the earlier.

          8. Scope of Application of Revocation Rights

          The right of revocation does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.
